You have to feel sorry for the poor guy with the permenant injuries he has sustained, but i fail to see how the pub is to blame.
Smoking truly is bad for your health, but can make money for you.
Another sign of of our litigious society. I think the 3 OR 4 OR ?? pints consumed may count against him. His judgement would have been impaired. Also the phrase forced to go outside for a cig by the smoking ban doesn't carry much weight. He chose to go outside.
Feel sorry for him but was it really the pubs fault and would a sign have stopped him from putting himself in a position of potential danger.

If the guy didn't smoke in the first place he wouldn't have fell. Why not go the whole hog and blame the drinks industry for making beer that gets people drunk.
