    Six months for breaching probation order

    A CAITHNESS villager who downloaded pornographic images onto his computer, was jailed for six months yesterday, after breaching a probation order.
    Malcolm Don, 42, twice breached the three-year order imposed in September 2012 although he successfully completed 200 hours community service he was also instructed to carry out.
    Wick Sheriff Court heard that Don, of 2 Seaforth Gardens, Halkirk, had been uncoperative with social workers and despite pleading guilty, had for some time, been reluctant to acknowledge the seriousness of what he had done.
    Police who raided a house in Pentland Place, Castletown, discovered a total of 3193 obscene images of children as young as 12 years, on his computer. The photos were found in various folders and sub folders along with 24 videos although they didn't portray sexual activity.
    Don was charged on indictment, with having, between July 2007 and June 2009, taken or permitting to be taken, or making indecent photos or pseudo photos.
    He was remanded in custody in October, following his continuing failure to co-operate with some aspects of the probation order. A social work report conceded that the only option left, appeared to be a custodial sentence.
    Sentencing Don, Sheriff Andrew Berry said it was important in such cases for an accused to accept help but it would not be fair to expect hard pressed social workers to continue to try to work with Don. A great many people had put a considerable amount of time, effort and expense in trying to keep the accused on the rails.
    In a letter to the sheriff, Don claimed he had broken the law and was obliged to plead guilty but had acted out of ignorance and made the point that it had been stated previously in court, that the pictures were not the worst of their type.
    Sheriff Berry commented: "They were certainly not family photos".
    He told Don: "You were very fortunate that you didn't go into custody, initially and I had considered a substantial prison sentence, at times".
    In addition to being previously placed on the Sex Offenders Register, for seven years, Don was made subject to a seven-year Sex Offenders Prevention Order, which places restrictions on his movements and communication with children, and computer and mobile phone use,
