Default Cases from yesterday's sheriff court session

Teen stole school goldfish and flushed them down toilet

A SHERIFF heard of a bizarre incident involving three goldfish which a teenager stole from a tank in Caithness school and promptly flushed down one of the toilets there.
The cruel act committed by Kevan Fraser was described by Sheriff Andrew Berry yesterday as “one of the most miserable of crimes” he had ever encountered.
Fraser, 17, admitted stealing the three goldfish on October 21 while the school, Lybster primary was closed for the weekend. He entered the premises through an insecure door and disposed of the fish after removing them from a tank.
David Barclay, prosecuting, said the janitor discovered the fish were missing when he arrived at the school on the Monday morning. Further inquiries were made and it emerged that Fraser had been seen in the vicinity of the school at the weekend. He told the police when interviewed that he had “just been stupid”.
Mr Barclay commented: “One view might be, that there are more serious crimes...unless you are one of the goldfish, of course.”
He added that the incident was compounded by the fact that Fraser was subject to a bail order at the time.
Sheriff Berry commented on the interest the pupils would have had in the fish and told Fraser: “I have come across some miserable crimes and this is well up there, with the worst of them. It was a singularly unpleasant and unncecessary thing to do.”
The sheriff added that the fact that the accused was subject to a bail order imposed only a few weeks before made the matter “far from trivial”.
Fraser, of 52 Glamis Road, Wick, was granted bail again and will return to court on February 8 when a background report will be available.

Speeding driver was hurrying to take mother for dialysis session

A WICK driver, caught speeding at over 100 mph on the main A9 was rushing to Wick to give his mother a lift to hospital for one of her dialysis.
Airport security officer Henry Grant, 35, admitted a charge of careless driving. He was fined £300 and banned for three months. The offence occurred on July 13, last year on a straight stretch of road at Hempriggs where the accused was clocked at 101mph in a 60mph speed limit.
Mr Barclay, prosecuting said, that while the charge had been reduced from one of dangerous driving it was, nevertheless, heading towards the top of the careless category.
Neil Wilson referred to the reason for Grant’s haste and that his mother required dialysis three times each week.
The solicitor added: “He realises he should have planned his day better.”
Sheriff Berry observed that Grant, of 9 Macleod Road, Wick, had a record for dangerous driving and driving while disqualified and told him: “You ought to have been fully aware of the requirements to comply with the Road Traffic Act. “
