Default Cases from today's sheriff court session

Car rolled after teenager lost control

A TEENAGER was flown south to hospital in Glasgow after the car in which he was a passenger crashed on the Latheron-Wick road, a court heard today.
The driver, Shane McPhee, was driving too fast for the road conditions and lost control of the car which rolled over a few times before it came to rest, on the A99, near Forse House.
McPhee (18) admitted driving dangerously and with excess alcohol when he appeared at Wick Sheriff Court. Sentence was deferred for reports.
The court was told that the teenager sustained multiple injuries including a fractured skull and was treated at the Glasgow hospital. He had been advised by his mother not to go out with McPhee but subsequently “sneaked” out and joined the accused, who was a friend.
It was stated that McPhee’s car was badly damaged in the accident in the early hours of September 29, 2010. Senior fiscal depute David Barclay said that the young passenger had not been wearing a seatbelt.
Mr Barclay said that it was not clear what had caused McPhee, who escaped with minor injuries, to lose control. He told police he remembered doing so, but had only “a faint recollection” of events after that. Police got the smell of alcohol and tests revealed a blood-alcohol level of 119 mgs-the limit is 80mgs.
McPhee, of Shelligoe Road, Lybster, will reappear in court on February 13 when Sheriff Andrew Berry will hear mitigation from solicitor Sylvia MacLennan.

    Failed to appear

A WARRANT has been issued for the arrest of a Fraserburgh fisherman who failed to appear to answer a charge of serious assault.
Shaun Brigham (45), of Broad Street, Fraserburgh, pleaded not guilty at a previous court sitting, after appearing from custody.
The charge alleges he assaulted Colin Creelman in Popey’s Bar, at Scrabster, on November 11 by knocking him to the ground, repeatedly punching and kicking him, and stamping on his head.

    Denies disorderly behaviour

A THURSO man is to stand trial on a charge of threatening or abusive behaviour.
Campbell Freeman, of Ormlie Lodge Thurso, denied the charge when he appeared from custody.
It alleges he picked up a kitchen knife from a drawer, at his home, in the presence of paramedics, ignored attempts to persuade him to put it away, and then used it to self inflict self harm.
The incident occurred on Saturday. Trial was fixed for February 16.

    Community service and driving ban

A Dumbartonshire man was ordered to carry out 45 hours unpaid work in the community after he admitted a charge of dangerous driving.
Kylie O’ Neil (22) of Tontine Park, Renton, admitted the offence which occurred near the Seaview Hotel at John O’ Groats, on July 7, last year. He was driving at an excessive speed when he crashed into a wall.
