HIV threat accused gets chance from court

A WICK WOMAN who attempted to bite police trying to arrest her, saying she was HIV positive and would infect them, was given a chance by a sheriff today.
Donna McPhee resisted to such an extent that it took five officers, taking extra care, to bring her under control.
She previously admitted, at Wick Sheriff Court, assaulting a constable and behaving in an abusive and threatening manner and breaching a bail order.
The court was told that McPhee 35, took exception to being arrested by police investigating a disturbance in Girnigoe Street, Wick, on January 6, and kicked Constable Fiona MacKintosh. The accused continued to struggle after being taken to the local police station where made her HIV bite bid.
Senior fiscal depute, David Barclay, said the threat got no further than an attempt which, however, was repeated and it was this that caused officers to handle the situation more cautiously than they otherwise would have done.
Sheriff Andrew Berry who saw background reports was advised that McPhee situation had stabilised.
However, he said that her behaviour had been “serious” and “wholly inappropriate”.
McPhee, of Green Road, Wick, was put on probation for two years and ordered to carry out 100 hours, unpaid, community service.
