Sheriff decides not to refer accused to High Court for breach of early release licence

A WICK man was handed a fourth-month jail sentence yesterday for driving while disqualified... but escaped a potentially longer term.
Ross Stewart, 22, was out on licence at the time of the offence after serving part of a 27-month sentence imposed by the High Court on charges of assault to disfigurement and permanent impariment. He was eligible to be returned there, for the unexpired part of his sentence to be considered.
Sheriff Andrew Berry said at Wick, that although there was a difference in the types of offences, the current road traffic case was nevertheless a breach of trust and he would have been entitled to refer it to the sentencing judge.
However, after careful consideration, he had decided against doing so, stressing that it did not detract from the gravity of the driving while disqualified.
Stewart, of 3A Ashley Court, Wick admitted the offence which occurred in Bridge Street, Wick on October 13 and having no insurance. In addition to the jail sentence, he was banned from driving for two years.
