Go through proper channels with neighbour disputes advises sheriff
A SHERIFF silenced a contractor's drill, today, before proceeding to hear evidence about a noisy saw.
Sheriff Andrew Berry tolerated the drilling on the site of the new council offices at the rear of the Wick court building, for some of the earlier, brief, business but expressed concern that the drill might prove too much of a problem during the trial.
The court duty police officer was dispatched to tell the driller to cease.
In the dock was Johnston Heath, 48, who denied having behaved in a threatening or abusive manner towards two neighbours who were using an electric saw to resize a door, in a shed, on December 23, this year.
Heath, of 19 Kennedy Terrace, Wick, was alleged to have resented the noise and shouted at them.
Sheriff Andrew Berry, who was told that there was a history of difficulty between the Heath and the neighbours accused of "making up a pack of lies" to get him into trouble,
The sheriff heard that the accused had shouted to make himself heard above the noise of the saw and said it was difficult to conclude that a crime had been committed. He found the charge not proven and advised that if Heath had cause for complaint in the future he should pursue it through the proper channels.
The court police officer left to inform the contractor that drilling could resume.
