Behaviour towards woman "deeply offensive" sheriff tells accused

A THURSO man was said to have no recollection of a drink-fuelled incident in which he grabbed hold of his crotch and made an offensive sexual remark to a woman.
Steven Johns, 29, admitted abusive and racially aggravated, behaviour and was fined £333 when he appeared from custody at Wick Sheriff Court yesterday.
He sat with his head bowed, in the dock, as David Barclay, prosecuting, outlined the circumstances of the incident, in Princes Street, Thurso, on Saturday night.
Mr Barclay said that the husband of Phoniwpa Carson, said to be of Tai descent, opened their front door about 11pm after hearing someone in the garden, to find two men there, both of whom were in an intoxicated state.
The fiscal depute said that Mr Carson got the impression they might have urinated round the side of the house and told them to be on their way. One of them moved off, but the accused remained.
At this point, Mrs Carson came to the door to get her husband to come inside and reiterated the instruction.
Mr Barclay continued: “At this point, Johns grabbed his crotch and made a totally inappropriate and foolish remark in an attempt at a Chinese accent.”
Solicitor Fiona MacDonald said that Johns, of 64 Royal Terrace, Thurso, had been drinking since 2.30pm that day and had “absolutely no recollection” of his behaviour.
She added: “He is deeply remorseful and upset and intends to send a letter of apology to Mrs Carson.”
Sheriff Andrew Berry described the accused’s conduct as “deeply offensive” and added: “The fact you were drunk is of no relevance whatsoever.”
However, the sheriff added that he didn’t consider the episode justified putting Johns on the Sex Offenders Register.
