Accused had to be subdued with CS gas... "prison the only sentence"
A MAN, who had to be subdued with CS gas as he swung a heavy metal chain at police, was jailed for three years, today, by a sheriff who said it was the only possible sentence in the public interest.
Douglas Wilkie, described as a prisoner at Inverness Prison, admitted on indictment assaulting the officers, being in possession of knives and breaching an early release from prison under a supervisory order.
The incident occurred after the police spotted Wilkie, 27, in Thurso Road, Wick, while on patrol, on June 18. When constables Brian Heriot and Ross Robertson went to speak to him, they noticed there was a knife sticking out of his jacket pocket. When they asked him to take his hands out of his pockets, the accused produced a heavy metal chain and began to swing it at them.
David Barclay, prosecuting, told Wick Sheriff Court: “Wilkie made some comment about ‘taking out the officers’. It was clear that he was adopting a violent stance towards them, so they deployed their CS gas spray. Initially Wilkie kept on swinging until it was clear the gas was affecting his ability to see what was going on, but the constables also had to strike him on one of his legs with a baton in order to disarm him and ensure public safety.”
At that point, Wilkie let go of the chain and the kitchen knife was removed from his jacket. Later at the police station, a Stanley knife was also recovered from him.
Sentencing the accused, Sheriff Andrew Berry referred to Wilkie’s extensive record which included police assault and told him: “You have shown no remorse, you don’t appear to have any positive outlook and have no plans for the future and even if help was offered, it is unlikely you would accept it. You tried to assault the police with a heavy chain and had to use gas and a baton to protect themselves. I consider it to be an extremely serious matter and sentence you to three years in prison.”
Jail sentences, imposed, of 27 months, for knives possession and a year for breaching his prison release supervision order will run concurrent to the three years sentence which will be backdated to July 19th when Wilkie was remanded.
The knives and chain were ordered to be forfeit.
