Relative claims Network Rail should have erected a barrier

LEGAL action against Network Rail is being taken by a man who lost close relatives in a crash at Halkirk.
Donald MacKay’s parents and uncle were killed when their car was struck by train at the unmanned crossing in September 2009.
Mr MacKay has now started a personal injury action against the company so that their deaths will not have been in vain. The case was on the calling list at the Court of Session in Edinburgh, last week.
Lawyer Cameron Fyfe said: “Network Rail should have erected a barrier and, had they done so the accident won’t have occurred.
Their warning light system is inadequate – if the sun shines into the lights, they are very hard to see.”
Network Rail has yet to comment.
