Was having a debate at work the other day about bank accounts and we thought of a strange scenario of an avon sales type situation.

Allan is the team leader for Bob. If Bob makes a sale he get commission, and Allan gets a smaller commission.

Allan puts some of his sales through in Bob's name without Bob's knowledge, and the commission gets put in Bob's bank account. Allan then ask Bob for the money.

They question we wondered was si Bob legally obliged to pass the money to Allan, and is Allan entitled to ask Bob for the money?

Beggars the question as to why Allan would put sales through in Bob 's name in the first place!
I would also question the suitability of Allan as a team leader if he does such a thing.

Quick answer is "no" to both scenarios.

Allan has no entitlement to any money in Bob's account albeit Allan put it there himself.

IMO Allan should offer up his job as Team Leader to Bob. Bob could then pay for the course whidh would re-educate Allan in the principles of good manners, business ethics etc.

Bob would probably have to pay extra because of Allan's spelling. ;)

No and No.

The money that has been paid into Bob's account is between him and Avon, nothing to do with Allan.

I would also say that Allan could face fraud charges for altering Bob's claim without his knowledge.

If they both agreed to do this, just to take advantage of Bob's higher commission rate, then they are both defrauding Avon. Allan is definately in the wrong either way.
